Terms & Conditions

Introduction

These Terms and Conditions ("Terms") govern the provision of Positive Behaviour Support services by Sally Smith Positive Behaviour Support ("I", "my", or "the service") to NDIS participants ("you", "your", or "the participant"). By engaging my services, you agree to these Terms.

Service Agreement

When you engage my Positive Behaviour Support services:

  • A formal Service Agreement will be provided and signed by both parties before services commence
  • Services are tailored to your individual NDIS plan, goals, and behaviour support needs
  • I will work collaboratively with you, your family, carers, and your support team
  • You have the right to discontinue services at any time with written notice
  • I reserve the right to terminate services with 14 days' written notice if necessary

NDIS Requirements

To receive Positive Behaviour Support services, you must:

  • Have an approved NDIS plan with Positive Behaviour Support or related capacity building funding allocated
  • Provide a copy of your current NDIS plan or plan budget
  • Advise me of any changes to your NDIS plan or circumstances
  • Ensure sufficient funding is available for services provided

Fees and Payments

Service fees and payment terms:

  • Services are charged in accordance with the current NDIA Price Guide and Pricing Arrangements
  • Invoices are submitted directly to the NDIS through the myplace portal or your plan manager
  • For plan-managed or self-managed participants, invoices are issued monthly or as agreed
  • Payment is expected within 30 days of invoice date unless alternative arrangements are made
  • You are responsible for ensuring adequate funding remains in your plan
  • Services may be suspended if invoices remain unpaid beyond 60 days

Cancellations and No-Shows

Appointment cancellation policy:

  • Notice required: Please provide at least two (2) clear business days' notice to cancel or reschedule
  • Short notice: Where less than two clear business days' notice is given and the appointment cannot reasonably be filled, the applicable NDIS Short Notice Cancellation fee may apply
  • No charge: No cancellation fee applies where the appointment can be filled, exceptional circumstances apply, or claiming is not permitted under NDIS Pricing Arrangements
  • Provider cancellation: If I need to cancel, I will notify you as soon as possible and offer another appointment at no cost

Scope of Services

Positive Behaviour Support services may include:

  • Functional and comprehensive behaviour support assessments
  • Interim and comprehensive Behaviour Support Plans
  • Behaviour Support Plan reviews and updates
  • Training and coaching for families, carers, and support workers
  • Liaison with schools, providers, allied health, and other stakeholders (with consent)
  • Attendance at case conferences and collaborative planning meetings
  • Restrictive practice identification, review, and reduction planning where applicable
  • Report writing and clinical documentation as required

Services do not include: Direct personal care, plan management, therapeutic interventions outside my scope of practice, or legal or financial advice. I will refer you to appropriate specialists for these needs.

Confidentiality and Privacy

I am committed to protecting your privacy and maintaining confidentiality in accordance with the Australian Privacy Act 1988 and NDIS Practice Standards. Personal information will only be shared with your explicit consent, except where required by law or to protect safety. For full details, please refer to my Privacy Policy.

Complaints and Feedback

I welcome your feedback and am committed to resolving any concerns:

  • Complaints can be made verbally or in writing to hello@sallysupport.com.au
  • All complaints will be acknowledged within 2 business days
  • I will investigate and respond to complaints within 14 days
  • If you are not satisfied with the outcome, you may escalate to the NDIS Commission

Incident Management

In the event of an incident, accident, or near-miss involving you or Positive Behaviour Support services I provide, I will follow NDIS incident reporting requirements. This includes reporting reportable incidents to the NDIS Commission within required timeframes and working with you and relevant parties to prevent recurrence.

Your Rights and Responsibilities

Your rights include:

  • Being treated with dignity, respect, and without discrimination
  • Having your privacy and confidentiality protected
  • Making informed choices about your supports and services
  • Accessing your records and requesting corrections
  • Providing feedback and making complaints
  • Being free from abuse, neglect, violence, and exploitation

Your responsibilities include:

  • Treating me and members of your support team with respect
  • Attending scheduled appointments or providing adequate notice of cancellation
  • Providing accurate information about your needs and circumstances
  • Informing me of any changes to your NDIS plan or contact details
  • Working collaboratively toward your goals

Liability and Insurance

I maintain professional indemnity and public liability insurance as required by the NDIS. While I take all reasonable care in delivering Positive Behaviour Support, I am not liable for the actions or services provided by third-party providers you choose to engage. I recommend you review service agreements and insurance coverage with all providers involved in your support.

Changes to These Terms

I may update these Terms from time to time to reflect changes in my services, legal requirements, or NDIS regulations. You will be notified of any significant changes, and continued engagement of services constitutes acceptance of updated Terms.
